SUMMARY: Bequests: --1) to wife Mary the use of all household items for her life. --2) After wife Mary's death, household items to be divided equally between his nine named children: Mary now wife of William Clark of Northbourn, Miller; Nathaniel; William; Stephen; Thomas Harvey, Martin; Sarah Maria; Henry; and Christiana. If any of children have died leaving issue, then the dead child's share is split among his issue. --3) all the real estate, farms, lands and related monies are to be administered by executors until his youngest child reaches the age of 21. - --4) However if wife then dead or remarried or otherwise when youngest child reaches 21, Executors to use stated powers to carry on the Farming and Grazing Businesses. --5) They can sell the Businesses immediately after death or any time afterwards before the youngest child reaches 21 if Mary dies or remarries etc. --6) Upon all sales etc., and relinquishments collect all monies and recoverable o/s debts etc.etc. Then invest the monies in Exors. names to produce from Public Stocks, Mortgages (of good sound nature) etc. and to vary the investments accordingly. --7) The net yearly proceeds (such as the £1000 or greater sum, subject to monies already advanced to any of the legatees) to be paid to his children as and when or until they are 21 and to wife for her natural life provided she remains a Widow and unmarried. --8) Then after her decease or marriage to pay the whole net proceeds equally among the nine children, and if any die, to apply the monies as per clause 2 above to the dead children's issue if any, but only until such time as the youngest child reaches 21. --9) Upon further trust to pay £1000 or such greater sum, agreed, assessed, or consented or at the discretion of Wife and two other creditors, to be shared equally between the nine children until such time as the youngest reaches 21 for their 'Preferment and Advancement in the World'. (Presumably this is on an annual basis but is not clear from the Will ?) This is to continue during Wife's lifetime. However, if she dies or remarries, then the £1000 or greater sum plus all Estate monies are shared between the nine children in the way as before described -- but this seems to be subject to some sort of three month rule of their having received such sum. --10) The final section deals with the Exors, powers and personal liabilities as between themselves or when dealing with third parties, etc. [--VERY difficult to read.] Executors: friends Thomas Harvey the younger and William Horn Harvey of Woodnesborough.
