INFO | REPORT OF COURT CASE in London Times 30 Nov 1906. High Court of Justice. King's Bench Division before Mr. Justice Darling and a common jury. Case Gaverick v. Gretorex and Co. "This was an action against a firm of auctioneers and house agents for alleged negligence in making imperfect inquiries as to a tenant whom they obtained for the plaintiff and for an alleged fraudulent representation that the tenant was a man of large means who would be a responsible and respectable tenant." Mrs. Adelaide Gaverick was widow of dentist who lived at Grosvenor-house, Harvard-road, Gunnersbury. Husb died July 1904 and she instructed the firm (sole partner Ernest C. Elgood - business at Marlborough-gate, Hyde Park) to sell the house. In Feb 1905, house was not sold and Elgood wrote to Mrs. Gaverick saying he offered Mr William Mackenzie Fraser the opportunity to rent the house from March to July with an option to purchase it at the end of the tenancy. Mr Fraser moved in without paying the agreed amount and never did pay it in full. Upon investigation it was learned that Fraser was currently in jail for crooked financial dealings and had several court and bankruptcy proceedings in the past. "The jury found a verdict for the plaintiff for £195. (TimesLondDig 30 Nov 1906 p3A.) |
